The Customer and Eagle Transfer Services, Inc, (hereinafter-called ETS), agree to the following terms and conditions. Customers who are not present at the time of delivery of equipment are still held responsible for all terms & conditions set forth and may obtain a copy by fax, email, or USPS. ETS shall provide hauling and disposal services and equipment to the customer and the customer agrees to pay for said services as quoted and defined here on service ticket.

Disposal costs, fuel and travel to disposal sites, which ETS is subject to are significant cost of the service provided to the customer. ETS will increase the price of the collection and hauling services provided to the customer should disposal costs, fuel prices and travel distance increase. Any increase in disposal fees, fuel price or travel distance will be passed on to the customer immediately. Disposal charges consist of fees paid to disposal sites for their receiving solid waste materials plus carrying charges for handling, financing and verifications of these transactions. The carrying charges may be up to 15 percent (15%) of the disposal fees. Furthermore, in addition, ETS may also adjust other charges from time to time upon thirty (30) day notice prior to the effective date of adjustment.

Customer will be responsible for any loss or damage to the equipment, other than normal wear and tear & will be responsible for ensuring legally loaded equipment-including properly secured doors. Customer agrees to indemnify, defend and hold harmless ETS against all claims, penalties, suits, damages & liabilities for injury or death to persons or loss or damage to property from Customer’s use, operation or possession of the equipment.

ETS is not responsible for any damages to pavement, asphalt, curbs, sidewalks, lawn, trees, shrubbery, landscaping, or flowers resulting from weight of vehicles or dumpsters or from tire or truck width when servicing at designated areas agreed upon by customer. It is recommended that a sheet of plywood be placed on asphalt driveways for added protection and customer should be aware that saturated lawns may allow the container to “sink” into the ground.

Customer will provide unobstructed access to the dumpster. If it is not accessible or loaded improperly, and excessive time or an additional trip is needed the customer will be charged additional fees. Overweight fees will be accessed once dumpster is picked up and taken to the landfill. Customers will be charged for any weight over the tonnage limit at the current landfill rate. Extension fees will be charged for any dumpster remaining past the allotted time, either at the customer’s request or because on circumstances caused by customer (non-payment, blocked access, dumpster overloaded). Customers requiring specific pick-up times must make arrangements with dispatch at least 48 hours prior to pick-up.

Baltimore City requires a parking permit if the dumpsters is being placed on the street. Permit is the sole responsibility of the customer. Failure to obtain permit may result in the dumpster being towed without warning. If this occurs, the customer will be held responsible for any fines or fees associated with the return of the dumpster.

Customer agrees that dumpsters provided for construction and demolition wastes can have the following acceptable wastes, including but not limited to. lumber, plaster, windows, doors, insulation, roofing shingles, tiles, pipes, wires, carpet, metal (ferrous or nonferrous), paper, and cardboard.

Customer agrees that dumpsters provided for concrete, brick, block, slate and dirt cannot be mixed with other debris in dumpsters larger than a 20 yard. These products cannot go into a 30 & 40 yard dumpsters. Special rates are given for these products only. Other debris mixed with these products are not eligible for flat rates and customer will be charged the overweight fee and additional fees.

Customer agrees that dumpsters provided for land clearing, stumps, yard waste, and clean wood cannot be mixed with other debris of any kind. Special rates are given for these products only. Other debris mixed with these products are not eligible for flat rates and customer will be charged the additional fees.

Customer agrees that dumpsters provided for municipal solid waste cannot be mixed with other debris or unacceptable waste including but not limited to heat pumps, air conditioners, furnaces, paint/tar or their containers, adhesives, tires, yard waste, tanks, cylinders, creosote, oil, explosives, animal carcasses, drums, medical wastes, asbestos, and fluorescent bulbs. The waste material to be collected and disposed of by ETS will not contain any toxic, hazardous, radioactive, volatile, explosive, highly flammable, infectious, biological, liquid wastes, contaminated soils, or any waste listed or characterized as hazardous by the U.S. EPA or any other applicable state or local law. Customer agrees to defend, indemnify and hold harmless ETS against any damages, fines, or penalties arising from waste excluded above.

Certain unacceptable wastes can be hauled for an additional fee. Customer must obtain prior authorization for pricing and procedures for collection of certain unacceptable wastes. Including but not limited to the list of unacceptable wastes are tires, asbestos, refrigerators, air conditioners, heat pumps, furnaces and gas cylinders.
